  There is much confusion about whether the power of the chief executive transcends all three branches of government. The “three branches of government” is a political term that means the legislature, the executive, and the judiciary. The legislature makes the laws, the executive carries out the laws and makes government policies, and the judiciary decides if the laws have been broken. In western-style politics there is a separation of powers between these three branches. The term “separation of powers” means the powers of government are divided into the three branches of government. Each branch has independent powers and provides a check and balance against each other so that power is not abused.

  The central government’s Liaison Office director Zhang Xiaoming caused political outrage (anger) when he said in a speech the status of the chief executive transcends the three branches of government. He also said there is no separation of powers in Hong Kong. Political outrage increased when Chief Executive Leung Chun-ying agreed with Zhang Xiaoming that he holds a transcendent status. The verb “transcend” has many similar meanings. The adjective is “transcendent”. People who use the word should be careful to avoid misunderstanding. The Oxford Dictionary gives many synonyms for the word “transcend”, including “surpass”, “outrank”, and “rise above”. Some synonyms for “transcendent” are “superior”, “excellent”, and “paramount”.

  Zhang Xiaoming’s speech was in Chinese and he used the word “超然” to describe the chief executive’s status. There is no exact English translation although it is similar to the word “transcend”. Like the word “transcend”, it can mean different things. It can even be used to say the British Queen has a superior status although she no longer holds real political power. Outrage arose when the media and politicians interpreted Zhang Xiaoming’s use of the word “超然” to mean the chief executive is above the law. The Basic Law makes clear the Judiciary is independent and the chief executive is not above the law. Did Zhang Xiaoming purposely use a word with many meanings to send a subtle (indirect, delicate) warning to the opposition camp not to undermine (challenge, destabilize) Leung Chun-ying?

  特首權力是否超然(transcends)政府三權(three branches of government)引起很大爭議。The three branches of government是政治用詞,指立法、行政和司法這三個政府機關。立法機關立法,行政機關執法和制訂政府政策,司法機關則決定法律有否被觸犯。於西方政治體制,這三個分支間有權力分立(separation of powers),separation of powers意指政府權力以三權(three branches of government)劃分。每個分支都有獨立權力,互相監察與制衡,以防範濫權。

  中聯辦主任張曉明在講話中,談到特首的地位超然(transcends)政府三權(three branches of government),激起政治憤怒(outrage)。他說,香港並非三權分立(separation of powers)。當特首梁振英認同張曉明所說,他確有超然(transcendent)地位時,政治憤怒(outrage)直如火上加油。動詞transcend有許多相近意思,形容詞是transcendent。用這個字一定要非常小心,以免引起誤會。牛津字典為transcend這個字提供許多同義詞,包括“surpass”(勝過)、“outrank”(地位高於)和“rise above”(超出),transcendent一些同義詞則有“superior”(級別更高、佔優的)、“excellent”(傑出的)和“paramount”(至高無上的)。

  張曉明用中文發言,他當時用「超然」這個詞語形容特首地位。即使它類近transcend,並沒有確切英語翻譯。像transcend一樣,它可解作不同意思,它甚至可用以形容英女皇有上等地位,即使她已沒實權。當傳媒和政客將張曉明用上「超然」一詞,詮釋為特首高於法律時,就惹起眾怒(outrage)。基本法清楚說明,司法是獨立,特首不高於法律。張曉明是否刻意用上一個多義詞,去向反對派傳遞一個隱晦(subtle)訊息,警告他們別想暗中顛覆(undermine)梁振英?
